Terms of Service
Effective date:
These Terms of Service ("Terms") govern your access to and use of Parqlo (the "Service"). By using the Service, you agree to these Terms.
1What Parqlo is
Parqlo is a student-to-student marketplace that helps users list and book parking spots near participating campuses. Parqlo is not a parking operator and does not own, control, or manage user-listed spots.
2Eligibility and account verification
- You must be able to form a binding contract in your jurisdiction.
- Parqlo may require verification (including
.eduemail verification) for listing and booking to keep the marketplace student-only. - You are responsible for all activity on your account and for keeping your login credentials secure.
3Marketplace roles
Spot Owners ("Hosts") list parking spots. Renters book spots. You agree to provide accurate information and comply with all applicable laws, rules, and property restrictions that apply to the spot and your use of it.
4Listings, availability, and house rules
- Hosts must have the right to make the spot available and must ensure the listing accurately describes access, restrictions, and any requirements.
- Parqlo does not verify that a Host has the legal right to rent a spot (including permits, leases, HOA rules, or campus policies). Hosts are solely responsible for ensuring they have the right to list and rent their spot and for complying with all applicable rules and restrictions.
- Parqlo may review, reject, pause, or remove listings (e.g., for safety, accuracy, policy, or quality reasons). Unauthorized listings may be removed and may result in account suspension.
5Booking flow and holds
When a renter begins checkout, Parqlo may create a temporary PENDING booking with a limited hold window (for example, a ~10 minute hold) to prevent the same spot from being double-booked during payment. If payment is not completed, the hold may expire and the booking may be cancelled/expired automatically.
6Pricing, fees, and taxes
- Hosts set the base price for their spot (daily and/or monthly, depending on listing settings). Hosts receive 100% of the base price they set. Parqlo covers payment processing costs through the renter service fee.
- Parqlo charges a buyer service fee on top of the host's listed price. The fee tier may vary by trip length (e.g., daily/weekly/monthly/semester tiers).
- Taxes (if any) may be added where required. You are responsible for your own tax obligations.
7Payments and payouts
- Payments are processed through third-party payment processors (e.g., Stripe). Parqlo does not store full payment card details. Hosts must complete payout onboarding to receive payouts.
- A booking "starts" at 12:00 AM local time on the booking start date and "ends" at 11:59 PM local time on the booking end date (unless the listing specifies different start/end times).
- For bookings 30 days or less, payouts are initiated 48 hours after the booking ends. For bookings longer than 30 days, payouts are initiated in installments: 48 hours after each 30-day period is completed, plus a final payout 48 hours after the booking ends.
- If a chargeback or reversal occurs, Parqlo may offset future payouts or suspend payouts pending resolution.
8Cancellations, refunds, disputes
- Cancellations 24+ hours before the booking start receive a 100% refund of total (base price + service fee). Cancellations less than 24 hours before start receive a 50% refund of total. Refunds after a booking starts are not available unless there is a verified issue.
- Refunds are calculated based on amounts actually paid at the time of cancellation and the unused portion of the booking. Unused days are based on calendar days from the time the issue is reported and verified.
- If something goes wrong (spot inaccessible, misrepresentation, safety issue), you must report it promptly (generally within 3 hours of discovery). Verification may include photos, messages, property signage, or other evidence we reasonably request.
- Parqlo may issue refunds, credits, or other resolutions consistent with this policy (and where required by law), including where fraud, safety, or policy violations are involved.
- If a chargeback or reversal occurs, Parqlo may offset future payouts or suspend payouts pending resolution.
- Refunds and dispute outcomes may vary where required by law.
9Safety, conduct, and prohibited use
You agree not to:
- Use Parqlo for unlawful activity or to violate campus/property rules.
- Harass, threaten, stalk, discriminate, or harm other users.
- Post false listings, misleading information, or stolen content.
- Attempt to bypass verification, moderation, or security measures.
- Scrape, reverse engineer, or disrupt the Service.
10Location privacy model
Parqlo may display an approximate ("blurred") location for listings in browse mode and may reveal more precise access/location information only after a booking is confirmed, to support safety and privacy.
11User content
You are responsible for content you submit (photos, descriptions, instructions). You grant Parqlo a license to host, store, reproduce, and display such content to operate and improve the Service.
12Disclaimers
The Service is provided "as is" and "as available." Parqlo disclaims all warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13Limitation of liability
To the maximum extent permitted by law, Parqlo will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Parqlo's total liability for any claim will not exceed the amount of fees paid to Parqlo for the booking giving rise to the claim.
14Indemnity
You agree to indemnify and hold Parqlo harmless from claims arising out of your use of the Service, your listings, your bookings, your content, or your violation of these Terms.
15Changes to the Service and Terms
We may update the Service and these Terms from time to time. If we make material changes, we'll take reasonable steps to notify you (e.g., via the Service or email). Continued use after changes means you accept the updated Terms.
16Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Venue for disputes (if not otherwise required by law) will be in California courts.
